Trilemma Foundation Terms and Conditions

1.1 These Terms and Conditions (Terms) govern use of Trilemma Tournament Foundation websites, materials, programs, tournaments, and related activities. The organization operates publicly as Trilemma Foundation and is referred to as Trilemma or we. Covered hosts include www.trilemma.foundation, trilemma.foundation, data.trilemma.foundation, build.trilemma.foundation, 2026.trilemma.foundation.

1.2 By using the websites, applying, contributing, submitting work, or participating, you agree to these Terms. Application forms require contractual acceptance of these Terms. Browsing public pages is permission to use the sites under these Terms to the extent enforceable under applicable law.

1.3 Read these Terms with the Charter (https://www.trilemma.foundation/charter) and Privacy Policy (https://www.trilemma.foundation/privacy).

2.1 If documents conflict, this order applies: (1) a signed written agreement; (2) challenge, repository, license, or program rules that Trilemma expressly accepts; (3) these Terms; (4) the Charter. The Privacy Policy controls privacy matters. A repository or dataset license controls licensing of that material.

2.2 Informal emails, chats, forms, and posts do not amend these Terms unless an authorized representative clearly agrees in writing that the change is binding.

3.1 You must have legal capacity to accept these Terms. Programs are designed for university students and adults.

3.2 A minor may participate only with documented guardian or institution consent, including for any public name or photo. We may refuse participation where sanctions, export, platform, privacy, or security rules require it.

4.1 You may view and use public Foundation materials for personal, educational, and non-exploitative purposes subject to these Terms and any license on the material. You may not scrape in a way that degrades the service, bypass access controls, or present our materials as your own product without attribution and any required license notices.

4.2 Canonical legal pages remain https://www.trilemma.foundation/privacy, /terms, and /charter.

5.1 You must not harass others; cheat or fabricate submissions; probe or attack Foundation or third-party systems; misuse credentials; upload malware; or use the sites to break the law. We may rate-limit, suspend, or block traffic to protect the service.

6.1 Program and tournament rules (including 2026 event rules) apply in addition to these Terms. Participation does not create employment, partnership, or academic-credit rights unless a signed agreement says so.

6.2 You are responsible for what you submit. You must have the right to submit it. Public submissions may be published with your name or handle for attribution. You can request takedown of non-essential public attribution as described in the Privacy Policy.

6.3 If you use AI tools to produce work you submit, you must not present generated work as solely human-authored where the program requires disclosure, and you remain responsible for accuracy, originality, and license compliance.

7.1 Trilemma and its licensors retain rights in Foundation websites, marks, and materials except where an open-source, Creative Commons, or dataset license says otherwise. Respect the license in each repository, package, or dataset.

7.2 Build’s public documentation and agent corpus (`llms.txt` and related files) are published so people and tools can retrieve that public content. Publication is not a transfer of ownership and is not a grant of rights beyond the license stated on those materials.

8.1 Discord, GitHub, Google, CanadaHelps, LinkedIn, X, YouTube, university portals, and similar services are not operated by Trilemma. Their terms and privacy policies apply when you leave our sites. We are not responsible for their availability or conduct.

8.2 Donations are processed by CanadaHelps. Trilemma’s CRA charity account 745663427RR0001 is used only to identify the charity in that context. Donations are voluntary and generally not refundable except as CanadaHelps or applicable charity law requires.

9.1 Foundation materials are for education and research. They are not financial, investment, legal, tax, medical, employment, immigration, or other professional advice.

9.2 Sites and materials are provided “as is” and “as available.” To the fullest extent permitted by mandatory law, Trilemma disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.1 Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud or for death or personal injury caused by negligence where that limit is prohibited.

10.2 Subject to 10.1, Trilemma is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or opportunity, arising from the sites or programs, whether in contract, tort, or otherwise, even if advised of the possibility.

10.3 Subject to 10.1, Trilemma’s aggregate liability arising out of these Terms or your participation is limited to the greater of CAD $100 or the amount you paid Trilemma (if any) for the specific program giving rise to the claim in the 12 months before the claim.

11.1 We may suspend or end access or participation for breach, security risk, or operational need.

11.2 We may update these Terms. The Last Updated date identifies the latest text. The previous public version was titled Participation Terms and dated 2 May 2026; the URL `/terms` is unchanged.

11.3 These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts in British Columbia have exclusive jurisdiction, except that you may bring a consumer or privacy claim in a forum that mandatory law preserves for you.

11.4 If a provision is unenforceable, the rest remains in effect.
